TERMS AND CONDITIONS

 


RETAIL SALES

Payments for all Vivariums sold to the retail public are required to be paid for before dispatch on collection or on delivery if brought by vivbuilder rather than courier. If you are collecting or having your vivarium or accessories delivered by vivbuilder staff or courier a deposit of 20% is required in advance. The balance is due before despatch. On larger builds a deposit of 40% will be required this deposit is non returnable. Payment in full will be due before the goods are despatched from the unit to go by courier or collection will be allowed.Payment is by Credit/Debit card, Cash, Postal Orders or Cheque. Cheques should be made payable to: VIVBUILDER. Payment on a vivbuilder delivery can only be by cash unless the amount is covered by a guarantee card this option is not available for courier delivery
Cheque's not supported by a bankers card will be cleared through the bank before goods ordered will be released. This takes 4-5 working days.


ORDERING

when you placing an order you can submit the order by the following methods:
Submit an order form off the website for standard vivariums and accessories. You will be emailed back telling you the delivery charge. An informed decision can then be made as to whether you wish to proceed with the order. The email will also ask if you wish to continue with your order could you ring the unit to arrange payment or how to send payment to vivbuilder.  Orders will be kept on file for a period of 1 calendar month after this a new order will have to be submitted. by emailing us you are agreeing to our terms and conditions
Email your requirements for a quote and or pricing of accessories and vivariums You will be emailed giving the quote for the vivarium and or the accessories. You will be informed of delivery costs and be asked to ring the unit to arrange payment or how to send payment to vivbuilder. By emailing us you will be agreeing to our terms and conditions

Telephone

You can ring the unit and discuss your requirements. You will be informed of the cost of your vivarium and or accessories. Told the delivery charges and can then arrange what payment method you wish to use if you wish to proceed with the order. If you have received a quote online you will already have agreed to our terms and conditions if the phone call is your first point of call by placing an order you will be agreeing to our terms and conditions. Copies of the terms and conditions are on our website or they can be sent if requested by email or post.

Post

Post your requirements to vivbuilder and you will receive a phone call, letter or email informing you of the costs including delivery. You can then use any of the methods in the ordering section to order the goods


GUARANTEES ON GOODS

All accessories are subject to the manufacturers guarantee and should be returned with proof of purchase for a refund or replacement in the original box or packaging. Due to the nature of the vivariums when they have been set up they have been in effect damaged and are no longer guaranteed. If they have not had accessories screwed, glued or nailed etc in them and no animal has been in them they are guaranteed for 12 months against manufacturers faults

FITTING OUT VIVARIUMS

Whilst we are able to supply and fit the accessories in the vivariums, we will ask the customer where they want them placed. We will offer advise if requested but the ultimate decision is up to the customer If the set up is incorrect and the reptile gets hurt or damaged in any way we will not be held responsible. We will not cut and joint wires under any circumstances. . Ceramic light holder kits can be fitted but due to electrical regulations we are unable to fit the plug as this would need official testing which we are unable to comply with. We will supply the plug and 3 amp fuses for the kit.

TRADE SALES

Unless terms have been agreed (see terms section below) payment is to be made on delivery or collection. Payment is by Credit/Debit card, Cash or Cheque. The goods remain the property of vivbuilder until fully paid for. If the goods are not paid for we reserve the right to take back the goods. We will not differentiate between what goods of vivbuilders are paid for and what are not. Failure to allow us to take back our goods or to pay vivbuilder the outstanding debt will result in debt collectors being appointed and or court proceedings. The goods should be inspected on delivery. Any faults/damage should be reported with 24 hours after this the goods will be deemed as received in good condition. Discounts may be offered for bulk purchases this is not a fixed discount and is dependant on units ordered. For this reason the discount will change with each order if it falls under the units ordered discount allowed ratio.

PAYMENT TERMS FOR TRADE CUSTOMERS

Payment terms may be offered to some customers. These are offered at the discretion of vivbuilder and are on a strict 30 day term. That’s is they must be paid within 30 days of the invoice date

SHOP FITS

Whilst we will always try to quote accurately, there may be occasions when the original quoted price may have to increase. A full explanation will be given.  Upon ordering a shop fit out a deposit of 50% will be required in advance the balance is to be paid on delivery.

CLEARANCE OFFERS

These vivariums are not perfect and are sold as seen. We try to be as accurate as possible when describing damage or imperfections, if you find a slight blemish we have missed we feel that this would already be accounted for in the discount price and will not enter into correspondence over further discounts.

CUTTING SERVICE

Whilst we try to be as accurate as possible we ask that you allow + OR - 2mm of any dimension.

SIZES/MEASUREMENTS

Custom built vivariums will be built as per your specification if given in inches they will be built as such.  Our Standard vivariums are made in mm and all the inch sizes are rounded down to the nearest 00 for example a 2ft vivarium is 610 mm we cut at 600 this optimises the cutting on the board and ensures that we use less board and keeps down the cost to you. If you require the full inch conversion please state this at the time of ordering.

Refunds

If you are not happy with your standard vivarium or cabinet we will exchange or refund the purchase price. If the standard vivarium or cabinet has been altered in any way we will not refund or exchange. If the vivarium has been delivered to you and you have just changed your mind, we will only refund or exchange if it is returned in as new condition. We will not be held responsible for the cost of returning the vivarium. If you choose to return a vivarium or cabinet that is not damaged the delivery costs will not be refunded.

 Custom built vivariums will only be refunded in the event that we have built it incorrectly. We will build to your specification if when you receive the vivarium it is not as you thought it was going to be we will not be held responsible unless the mistake was on our part. Deposits are non refundable on custom built vivariums.

Out of stock items

Whilst we will always endeavour to deliver the exact item ordered on occasion be may be out of stock in this event we will substitute for the nearest available item that is the same price or more. Whilst we will always endeavour to send all vivariums in the requested colour it may be necessary to substitute with an alternative colour that is as similar as we can possibly get. If we are out of stock we will order goods in but we cannot be held responsible for the time it takes to arrive as this is not under our control.

POST, PACKING and DELIVERIES

We ask that you allow 28 days for delivery. We will always try to ensure that the goods arrive before that time but it may take longer due to elements out of our control. If we have had to order in the board or material and there is a problem with the suppliers we cannot be held responsible for problems that are out of our control.
Upon delivery all items should be inspected for damage and if you are not happy with the item you should refuse the delivery. If you accept delivery we cannot be held responsible for any damages. Signing for them as unchecked is the same as accepting a good/clear delivery and we will not be held responsible for damages. The courier companies set the terms and conditions for delivery so that if their conditions are not met they will not pay out on any claims for damages for this reason we have to apply these terms or we will not be covered for any damages and consequently will not be held responsible for damages that have been caused prior to the customer signing in good condition. If the courier company delivery staff objects to the goods being checked before signing you should refuse the delivery. Correspondence will not be entered into if you have not followed the delivery companies and vivbuilders terms and conditions.

All items on the website are subject to post and packaging charges. These will be arranged either by email after an order has been submitted or over the phone whilst arranging payment. Due to the nature of the products we sell the costs will vary so we have been unable to standardise the postage costs.
We use 3 types of postage method to get the vivariums and accessories to you these are

TNT
Pallet


Smaller items can be sent by the post office. Smaller vivariums and flat packed vivariums can be sent by TNT and will normally be under £30. Larger ready built and custom built vivariums are sent on pallets. The standard charge for a pallet ranges between £40 and £60 for mainland Britain dependant on where you are and how high the pallet is filled i.e. quarter, half and full. Ireland is £100. if the vivarium is over 3ft x 4ft it requires 2 pallet spaces and the cost of delivery will be doubled accordingly.

COMPLAINTS

If you have a complaint please in the first instance ring email or write to vivbuilder and we hope to be able to resolve the problem in the shortest possible time frame.
Any correspondence between client and vivbuilder is in the strictest confidence. Any attempt to publish the correspondence will be passed to our legal department and if deemed necessary legal action will be taken to stop this and damages sought for any provable loss of business. Any refund will be postponed until the dispute is resolved.

Laws and jurisdiction

In the vent that and of our terms and conditions are declared invalid or unenforceable such a determination shall not affect the other provisions of the contract all of which will remain in place
